Our services are designed for individuals, freelancers, small businesses, startups, agencies, and resellers, with a strong focus on Indian customers and potential global expansion.

2. Acceptance of Terms

By creating an account, purchasing a service, or using any HostDSS platform, you agree to these Terms and Conditions.

3. Eligibility

The person or entity listed as the account owner is responsible for all actions under that account.

You are responsible for protecting account credentials and for all activity performed using your account.

We may suspend or terminate accounts that provide false, misleading, or incomplete information.

5.1 Business Email Hosting

Managed email hosting services for professional communication, mailbox administration, and related delivery support.

5.2 Shared Hosting

Website hosting services on shared infrastructure with resource controls designed to protect service stability.

5.3 Domain Services

Domain registration and domain management services, offered directly or through accredited partners.

5.4 Future Services

We may launch new service lines such as advanced cloud or managed infrastructure offerings. Service features, limits, and specifications may evolve over time.

6. Payments and Billing

  • Services are billed on subscription terms (monthly, annual, or as displayed at checkout).
  • Renewals may be automatic unless canceled before the renewal date.
  • Late, failed, or reversed payments may result in service restrictions or suspension.
  • Pricing may change in the future. Updated prices apply from the next billing cycle unless stated otherwise.
  • Billing currency is shown during purchase. Payment processor conversion charges, if any, are your responsibility.
  • Applicable taxes, GST, duties, or levies are charged as required by law.

7. Refund Policy

  • Spam, phishing, spoofing, or deceptive messaging.
  • Malware distribution, botnet control, or malicious code hosting.
  • Illegal content, fraud, scams, or identity theft.
  • Copyright infringement and unauthorized distribution of protected material.
  • DDoS attacks, port scanning, or unauthorized access attempts.
  • Bulk abuse, abusive automation, or resource abuse impacting platform stability.
  • Unauthorized crypto mining.
  • Child exploitation material, terrorism-related content, or hate content prohibited by law.
  • Any activity prohibited by applicable local, national, or international law.

9. Email Hosting Rules

  • Outbound sending limits may apply by plan, mailbox, domain, or account reputation.
  • Spam filtering and abuse detection systems may block, delay, or reject suspicious messages.
  • Abusive SMTP behavior can result in IP or account blacklisting, temporary throttling, or suspension.
  • Mailbox retention periods may vary by service plan or account status.
  • You are responsible for mailbox content, user access control, and mailbox-level data hygiene.
  • You are responsible for independent backups of important email data.
  • We may suspend email services used for spam, phishing, or repeated abuse.

10. Hosting Resource Usage

Shared and managed hosting plans operate under fair usage principles to maintain service quality for all customers.

  • CPU, RAM, storage, inode, and database usage must remain within plan limits.
  • Automated scripts, crawler jobs, and cron schedules must not cause sustained platform strain.
  • Excessive traffic bursts or resource-intensive applications may be rate-limited or isolated.
  • We may ask you to optimize workloads, upgrade plans, or adjust configurations for stability.

11. Domain Registration

  • Domain availability is never guaranteed until successful registration is confirmed.
  • You are responsible for monitoring renewals, expiration dates, and registrar notices.
  • Expired domains may enter grace, redemption, auction, or deletion cycles under registry rules.
  • Domain services are subject to third-party registry and registrar policies, including ICANN requirements where applicable.
  • WHOIS and registrant information must be accurate and maintained as required by law and registry policies.

12. Backups

Backups provided by HostDSS are best-effort and may vary by plan, service architecture, and operational conditions.

You must maintain independent backups of critical data. HostDSS is not responsible for data loss, corruption, or recovery failures.

13. Service Availability

We work to deliver high availability, but uninterrupted service cannot be guaranteed.

  • Scheduled maintenance may occur with notice where practical.
  • Emergency maintenance may be performed without prior notice.
  • Service quality may be affected by network disruptions, upstream issues, or third-party outages.
  • Force majeure events may impact service delivery.

14. Intellectual Property

You retain ownership of your content and data.

HostDSS retains ownership of its platform, software, website materials, branding, logos, documentation, and custom systems.

15. Customer Content

You are solely responsible for all data, files, websites, emails, and communications stored, transmitted, or published through your account.

16. Privacy

Our data handling and privacy practices are described in our separate Privacy Policy. Your use of HostDSS services is also governed by that policy.

17. Suspension and Termination

HostDSS may suspend, restrict, or terminate services for reasons including:

  • Policy violations or abuse.
  • Non-payment or unresolved billing failures.

Where necessary to protect systems, customers, or legal compliance, action may be taken without prior notice.

18. Limitation of Liability

To the maximum extent permitted by applicable law, HostDSS is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, or downtime outside our reasonable control.

Our total liability for any claim related to paid services is limited to the amount paid for the affected service during the billing cycle in which the claim arose.

19. Indemnification

You agree to indemnify and hold HostDSS, its affiliates, and team members harmless from claims, damages, losses, liabilities, and expenses arising from your misuse of services, your content, or your violation of these Terms or applicable law.

20. Third-Party Services

Some services depend on external providers such as domain registries, payment gateways, SSL issuers, cloud vendors, and platform integrations.

Those services may have separate terms, policies, and operational standards that also apply to you.

21. Changes to Services

HostDSS may modify, upgrade, replace, or discontinue service features. We provide reasonable notice where practical, especially for material changes.
